Court ordered change of surname

The court have just granted me with an order to change my child's surname. The father has been given 21 days to contest this (he didn't bother to show up to either of the hearings and sent a statement within which he actually stated he wasn't even sure he was the father, just when I thought he couldn't actually stoop any lower!).

Anyway, does anyone know what I need to do? Is it simply a matter of applying for the deed poll change? Obviously along with a copy of the order... and passport? Birth certificate? Obviously I won't do anything until the 21 day period is up, just in case, but my solicitor is on leave next week and to be honest, she said this was her first successful name change in 15 years as it is so rare that the courts grant it, so she wasn't sure herself of the next steps.

Anyone got any advice?

Simple change of name deed. That's all. Refer in it to the order, and make sure the 21 days has passed first. Will the court be issuing a further order to confirm no challenge has been made?

wobblingalong · 06/04/2019 11:40

Thanks collaborate. No, there was no mention about a further order, just that he had 21 days to contest it... do I assume if I hear nothing further then I am good to go?

That really depends on the wording of the order. Might the court have intended to make the final Order after 21 days?

wobblingalong · 06/04/2019 15:12

It says at the bottom 'the father shall have liberty to vary or discharge this order within 21 days from the date of this order.'

Does that clarify it?

Sorry under the specific issue - change of name, it says 'the child, first name - middle name - his surname. shall now be known as first name - middle name his surname - my surname' (the magistrates suggested keeping his as another middle name to try and prevent him contesting it).

Then it says what I've put in my previous post.

Sorry to bump this. My solicitor says I don't need to do anything re the name change, not even change it by deed poll?? She says that the court order is all the evidence I need and has just said that the passport needs to be changed if I wish to travel. Can anyone confirm if this is correct?

wobblingalong · 09/04/2019 09:03

Opps forgot I had name changed. The post below was me Blush

Just follow the advice your solicitor has given you. It’s a court ordered name change and your solicitor will have more expertise in this area than randoms on MN

wobblingalong · 09/04/2019 09:10

Yes good point. Thanks.

You don't need to do a deed poll, I don't think you can under 16 anyway.

Just send off for a new passport with a copy of the order.

Oh and I agree with your solicitor knows more, and they are also being paid to tell you.

The court order is sufficient.
