I'm looking for some advice on potentially taking a national housebuilder to court.
Currently we have some sort of damp issue. This is the third time it has happened in as many years. Housebuilder has previously 'fixed' it. They have agreed to fix it again even though it's now out of warranty, as if it had been fixed correctly the first time, we would not be having this issue now.
The latest drama has been on going since October. They cannot agree on what is causing the issue and have sent various contractors round as well as the site manager (who claims he could fix it there and then but best to go through customer care.)
I have done some googling and can see I need to give them one last opportunity to resolve the issue (and a timeframe e.g. 28 days.) I'm also going to put in a service access request under GDPR for our plot.
If they do not fix it in this time frame and I get a third party into fix it, could I bill them directly for works done (if I were to advise them prior of my intentions)?
Or would I need to go to small claims, and would I win?
