To spend some of our DP 's money when they are self funding in care home.

Posted on AIBU, didn't realise there was a specify thread for legal advice -Both of my DPs have gone in to care home due to ill health. They now wish to gift youngest grandchild £1000, when they pass their driving test as they did with older grandchildren. Would this be considered 'deprivation of assets'? Their assets total over £300,000 with an annual income of £25,000. DM has full capacity and wishes to gift this sum. DS and I hold LPA. DS thinks it is okay but I am hesitant.

It's fine. You will be able to demonstrate that there is a precedent for this. It would count as legitimate expenditure not an attempt to avoid fees. Not extravagant and with full capacity no question of manipulation arises.

I think some of the advice given on your other thread was that it could potentially be seen as deprivation of assets and to seek proper legal advice

People are allowed to spend money even if they are in a home! In the circumstances £1000 is negligible. It’s not £100,000! Just do it. They are entitled to give a bit away as before and be caring grandparents - their normal way of life doesn’t give to stop.

It is their money they can gift it as they wish.
