It's a list of documents you intend to rely on to prove or defend the claim. It's about both parties putting all their cards on the table, so no ambushing the other side. Quite often when you know the strength of the other sides case, you might agree to settle out of court.

I believe these Deed of Trusts are a way to put the assets in a divorce out of reach and to defeat the claim . Yes / No ?

Sort of. A Trust is usually not a matrimonial asset so doesn't go in the pot when deciding who gets what on divorce. The court will look at the Trust and if it decides it's a sham, the Trust property will be treated as a asset.

But that is my point . It was not entered into when the property was purchased but only when a divorce was on the cards .

A trust is still an asset. The court can and will take it in to account even if it is not a sham. The court has the power to vary the terms of some trusts if they are deemed to be post-nuptial settlements.

If you have a case that involves these issues you really ought to get some proper advice.

My last question and then I will go away . When the court has ordered and I quote ;There should be a standard disclosure by list in relations to the issue of beneficial ownership in ..........by 4pm on the ......

Does this mean you file this to the court or to the opposite side ?
