Sit tight and do nothing or apply for a prohibited steps order?

Contact between ex and DS broke down around 8 weeks ago. He hasn't seen him since. It broke down due to ex's alleged drug use (prescription medication), driving under the influence and some other minor issues.

He hasn't seen DS in 8 weeks. He has blocked all contact. I arranged mediation and he didn't attend his session. I don't hear from him except once a week when he sends a long rambling text about TAKING ME TO COURT!!!!! and GETTING CUSTODY!!!!

Today he told me he has been told he can remove DS from nursery any time he chooses and there is nothing i can do about it. Nursery have confirmed that is true and that although they would try and stall him and give me time to get there they cannot stop him from taking DS.

I would like a PSO to say he can have access at his mothers house but cannot remove DS from her care or from nursery. Is this something I would be likely to get for the short term?

Or alternatively sit tight and put it down to bluff and bluster and wait for him to TAKE ME COURT!!!!

(the CAPS and !!!! are his Wink)

You would probably get a PSO given his threat, but you'd have to assess whether it's an empty threat or not. If you apply to court for an order the court will have to deal with contact, but if you don't take it to court and he doesn't do anything...
