Inheritance for unborn child

Does anyone know if, a grandchild that was conceived before the death of a grandparent, that the grandparent knew was coming when they died, will be included in a will stating money should be "divided equally between my grandchildren"? Or because they wernt quite born they don't count?

An unborn child is not legally a person so I would assume no. This thread is very similar to another thread I read this morning.

But yes, answers will be the same as your first thread. If they weren't born it doesn't count unless the will specified this as a clause.

And no, I don't think the unborn child would count unless specified as they weren't alive when the grandfather died.

The answer is the same. Grandchildren mentioned in a will refers to live children or recognised issue. Unborn children do not count as they don't exist yet. Unless specifically mentioned, unborn children will not benefit from a bequest.

Why would you ask this again?

I’m a solicitor who administers estates and drafts wills. Unless specifically provided for, the grandchildren need to have been born before the date of death. The adopted grandchild will be excluded so it’s just a two way split.

You said it was a 10k inheritance right? To be distributed throughout grandchildren. So surely that's only £1-2k for your child? Why are you chasing it? It makes you look desperate. If it was over £3-4K per grandchild I'd query it but nothing below that is worth falling out with family imo.

Money is different to different people, there are 4 of them so 2.5k each a lot of money to us but I know not to some

Where would it stop? What if three more grandchildren were born over the coming years? Should the inheritance be kept aside until all children have passed childbearing age to ensure no further grandchildren and only then distribute the inheritance?

You obviously didn’t listen to anything on the previous thread so why don’t you just go and consult a lawyer who specialises in inheritance, if you’re so bothered about it?

I don't get why you would begrudge £2.5k to children in care.

Your child has a massive advantage over his or her cousins. Just leave it.

Give the OP a break. Posters suggested she repost in Legal and that’s what she’s done. But yes a real life solicitor would be better (and less judgemental).
