Bailiff blocking me in.

Hi I had a bailiff call this morning and he blocked my driveway for over an hour which resulted in the children being very late for school. My car is on finance so he couldn't take it anyway. He just sat on his van bonnet smirking at me. I found him very aggressive and intimidating even though I was trying to arrange some sort of payment plan but he was having none of it and wouldn't move! Does anyone know if he's allowed to block someone in like that for that length of time?
Many thanks

Was he on private property?

Soontobe60 · 06/02/2019 18:14

So you were trying to leave whilst the bailif was there. Why? You should have contacted someone to come and take the children to school whilst you sorted out the bailif.

If he's in private property, call the police and have him removed for trespass

LaurieFairyCake · 06/02/2019 18:23

If he can't take it legally you should have called the police and they would have told him to move

Sorry you're having a horrible time Thanks

My ex-mil had terminal cancer and the bailiffs did this when she was having chemo (a debt she knew nothing about). The police moved him and put a rocket up his arse - they threatened to arrest him (he got lairy)

Ribbonsonabox · 06/02/2019 18:25

Call the police! They have no right to be intimidating or to prevent you from leaving. I'd also make a complaint to the company he works for.
Sorry you were struggling Flowers

@callieisdoingit there but for the grace of god..

iklboo · 06/02/2019 18:30

Pay your bills and you wouldn't have bailiffs knocking!

Nice.

TantrumsAndBalloons · 06/02/2019 18:30

The police won’t help. It’s a civil matter. The police can arrest you for obstructing an enforcement officer and preventing him from doing his job, believe it or not

TantrumsAndBalloons · 06/02/2019 18:30

He can’t lift the car but technically can immobilise it

TierrasMumma · 06/02/2019 18:31

Thank you to most of you for your advice. As for others saying get someone to take kids to school. They go different schools and one has special needs and wouldn't go with them anyway! As for pay your bills and they won't come knocking- I've not long come from a safe house back to my home so was unaware of the debt! Jeez people are so quick to judge!! Don't think I'll be posting again. I've never posted before and this is what happens. No thanks

OP ignore the horrible comment. I've reported it.

I bet that was really upsetting having him block you in. No idea how these things work but I really hope things improve for you Thanks

Go on Facebook and look for beat the banks and bailiffs and similar type groups, they know their stuff!!

Most people believe you have to pay bailiffs, but in actual fact you don't and most do not have the right to threaten or intimidate you or make you pay.

The only one's that do are for council tax and government type debts.

In this instance he should have been removed by the police, however the police often do not understand the legal abilities of bailiffs and tend to ,wrongly, side with them.

If you have any disabilities or anyone in the house, mental disorders or you are on benefits you can write him and the collection agency a letter, stating you they do not have the legal right due to xxx circumstances.

www.citizensadvice.org.uk/debt-and-money/action-your-creditor-can-take/bailiffs/how-bailiffs-should-treat-you/how-bailiffs-should-treat-you-if-youre-vulnerable/

If that doesn't suit your situation you can contact the agency with the one letter method. It is like the three letter method, only 1 letter. Lots of Google about that but it is covered in the Facebook groups. This means you can possibly write off the debt. It depends on the type of debt, it is for credit type debts, not Government.

Isn’t it an offence to block access to the highway?
