car accident with horse

in june our car was written off by a horse that had got loose running onto the road and into our car.

Hubby was driving and myself and 2 year old SN DD were in the car. Police attended and said we were lucky to be alive - which we really are!

I had literally just settled a car accident claim that afternoon where someone had driven into me. I spoke to my solicitor after this accident and she agreed to fight our case.

The problem we are having is that all 3 of us were injured (7 months later i am still having physio on my shoulder) and the owner of the horse is claiming he has no insurance, and won't answer letters our solicitor sends him and his own solicitor has told our solicitor to stop calling! He has admitted that the horse wasn't on his land but won't actually tell us where the horse was kept!

Obviously we want to claim for injuries and the cost of our car (it was only 2 months old) as we don't want our insurance to take a hit.

has anyone experienced anything like this?

Agree with previous poster, had this been a wild deer/stag you would have to let it go. It was an accident. As someone still processing a no fault crash where my family were also injured I understand it's hard to just put it behind you. Maybe seek some counselling for post traumatic stress..

The relevant act is the Animal Act s2(2) and the issue of strict liability in the circumstances Op has described was tested in Mirvehedy
v Henley in 2006. It's a House of Lords case which means it sets a precedent and is still good law today.

To side with the OP I wouldn't give a fuck about the horse if my children had been endangered and injured.

I would also be very angry with the owner for not taking responsibility and in no way would I feel sorry for his loss.

Buttyblahblah it isn't exclusive. I have immense sympathy for the Op and her children for experiencing what must have been a horrifying experience, I also have sympathy with the horse which must have been frightened to have bolted and lost it's life and yes, sympathy for the owner who has lost what may have been a friend, and probably a valuable animal. However my sympathy is extremely tempered by what appears to be his failure to have 3rd party liability. It is available by becoming a bhs gold member and to my recollection is less than 80 quid a year.

I'm definitely just going to let it go. It's causing too much stress and I really think it's time to just move on.
