Specific Issue Order or Removal from Jurisdiction order

Hi
I had another thread before Xmas. I've been offered a job in China and want to take my children for 3 years. It's a great offer and the children will have the opportunity to attend a fabulous school, that I would never be able to afford over in the UK.

My ex (not seen them for 2 years / has always refused to pay maintenance - works cash-in-hand etc) finally gave an address over Xmas (his Mum's).

I've sent a consent letter for him to sign, but I don't think he will. He also told the mediator he would speak to her, but didn't answer the phone when she called him.

So I think it'll be the court route.

I'd like some advice on the type of course order to apply for. A solicitor told me it would be a specific issue order.

However my mediator told me it would be a removal from jurisdiction order.

It will be for 3 years!

Can anyone help?

I also think it likely that he just won't bother filling out and returning the C7. It took him 2 months of repeated asking for him to bother giving me his Mum's address and he refuses to communicate about the letter I sent over Xmas.

Plus when I was chasing maintenance he didn't bother filling out the CSA forms either.

So I think it is highly likely he won't return the forms.

What will the court do if he doesn't bother showing up, but we could prove that he'd had the court documents served on him?

There is no such thing as a removal from the jurisdiction order - it is a specific issue order you need to apply for. Under a SIO the court can grant leave to remove.
