Car crash who’s at fault?

Nettle80 · 13/11/2018 09:29

This morning I was driving along a straight road. A car that was parallel parked on the other side pulled out on me. Hit me just behind my drivers side door. The man driving said a car had flashed him go so he assumed it was clear my way. He wants to track this driver down because apparently it’s their fault as (his words) you’re not allowed to flash people to go? Surely it’s his fault for not checking my way? I know 100% that it’s not my fault but i just want my car fixed. Would our insurance companies really wait for this man to get hold of any cctv/witnesses? Ive been driving 6 years & never been involved in an accident before so I have no idea how this all works.

His fault - he should not have reacted to another car flashing nor pulled out without checking mirrors and blindspot.

His Fault. Even if he found the driver who flashed him. He made the choice to pull out.
Take pics, and through insurance only.

In essence it doesn’t matter. Your insurance company will deal with it and chase payment from his insurance company. There is no delay no matter if there is a dispute about who is ultimately at fault.

It's his fault. Flashing someone doesn't mean anything strictly speaking, in real life of course we all know it means go, the responsibility is on the driver to check they can go. Just leave it in the hands of your insurers, that's what you pay them for. I know it's hard not to stress though

TooTrueToBeGood · 13/11/2018 09:34

I've heard that story about drivers being in some way liable if they signal someone that it's clear when it's not. No idea if there's any actual truth in it though and it could well be an urban legend. From your POV, it doesn't matter. As long as you were driving within the limit and with due care and attention it's not your fault. Just report the facts as you see them to your insurers and let them sort it out. Drivers really should't be discussing fault as it could lead to ne of them invalidating their cover which does nobody any favours.

It's his fault, even if what he says is true. Go through your insurance.

This is why I have a dash cam fitted.

BrokenWing · 13/11/2018 09:36

It is his fault. You should have his details, phone your insurance and ask how to place a claim, they will sort it out with his insurance and you wont need to talk to the guy again.

They will not waste anyone's time trying to trace the other driver. Drivers are 100% responsible for checking their own way is clear and should not rely on/trust signals from another motorist.

Thank you everyone! Although he admitted it wasn’t my fault he was just so adamant that it wasn’t his either.

On the plus side, if he does track down this other driver they might have some lovely dash cam footage clearly showing it's the guy who pulled out's fault.

It clearly states in the highway code that flashing your headlights is to let other road users know that you are there, and that you should not flash your headlights for any other reason. Let your insurance deal with it as its very clearly his fault and no one elses..
