Stroke and no power of attorney

I am looking for ideas from you knowledgeable types.

My grandfather has had a massive stroke and has massively reduced cognition and mobility now. As he has been deemed incapable he has not been able to give my father POA. In his will he has given my father POA.

Father is living hand to mouth and has had to take time off from his job to deal with grandfathers financial issues - but cannot as he has no signing power for financial accounts. There are no other family members in the country apart from my father and my sister.

Do any of you have any suggestions as to how my father can gain signing authority to sort out the financial issues so that my grandfather's accounts can be sorted and he can be placed in a home?

Unfortunately, grandfather owns the taxi company that father drives for - making things even more tricky.

If only he had listened to me a year ago when I suggested they sort these sorts of things out Sad

I am very much not ok as am in another country altogether, but better than my poor father. Thank you for your kind thoughts Fourpaws

Oh I am sorry for you. I'm afraid I could have helped if Scotland but not England. Hopefully someone will be along soon who knows the position there. Here it would be guardianship but not sure if that's the same or indeed the correct procedure there.

If there is no POA your Father will have to apply to the Court of Protection for someone to be appointed to make the decisions for your Grandfather. Tell you Father to contact Age Concern or CAB and they should be able to point him in the right direction.

It is not an easy process and I wish you all the best trying to sort out matters.

I found the Court of Protection to be really helpful when I had to deal with them.

Thanks FiveShelties that is heartening. He already has so much to deal with, and has suffered a stroke previously that I really worry what this process will do to him.

I really feel for you - I am in a different country to my family and it is a nightmare when something happens. I recommend ringing the Court of Protection as I found emails took quite a while to be answered. I wish you all the best with it - a very difficult time for you all.
