This is a bit specialist but am hoping someone here might be able to help.

Basically I've had a letter from council housing officer saying :

"due to the Housing Act (Wales) 2014 your previous on going housing registration application (made in May 2009) was destroyed (including all medical evidence provided in support) and you, legally, according to this act, must make a fresh online application and if you choose not to then this is your choice and you are not allowed access to the housing register without doing this. Legally we can not allow you to continue on a paper application or to use old evidence".

I can't find anything that says it's illegal for me to have a paper application. My reasons for not using the online one are currently subject to a separate legal investigation.

Most of my county doesn't have access to the Internet, and though they cite my evidence as being old, it was kept up to date and my Drs refuse to provide me with any evidence for a fresh application having done so and it been destroyed, seemingly for no reason.

Can anyone help me find the relevant part of this act? There's no cab or similar here I can go and ask or I would.

The separate investigation is to do with confidential information being made available on their website for several years and ignoring concerns that were raised.

Did you not keep copies of your original evidence? IT always pays to copy things before sending them. Or are they stored elsewhere on your computer or in an old box? Have a very good hunt.

If you rely on the state for anything it always lets you down and messes you around so it might be worth seeking better paid work and avoiding any state provision.

You can obviously use the internet and if there was a data breach in the past that does not mean there will be this time so why not just proceed on line?

Surely your GP has to give you your medical records if you make a data access request and could not hold them back from you?

Thanks for the advice.

I've copies of everything. But I can't use old evidence, it must be dated within three months of applying and uploaded to their insecure website which advertises all the data stored.

I can use MN. MN is nothing like their website which requires a constant internet signal which I do not have so in order to use it I'd be forced to travel over an hour in a taxi which medically I can no longer manage.

They caused a data breech of my data previously which meant I was taken to court for a debt that wasnt even mine and made to pay it due to lack of support here. That was because housing sent me an insecure email with all my details in after explicitly being told not to do this. I cannot trust they won't do it again. I cannot afford to risk them doing it again, I'm paying off this debt that isn't even mine because of them. I know it was due to their email because of an error in the claim (error that I wouldn't make but they always do with my name and address) but it wasn't enough to prove I hadn't fraudlently claimed the money it was claimed I did.

Currently they're being prosecuted by the ICO after confidential data that had been published on their website was republished.

I can't work due to disability, which is becoming increasingly worse and my current landlord refuses to give me a contract. I can't find anywhere else that'll accept me (I am trying) if there was any other option at all I'd be taking it. At present I'm looking at returning to previous abuse when my current landlord evicts me.

Not literally advertises data just says what's in there e.g. NI, address, bank account details etc.

Sorry. To clarify they want personal letters from medical professionals regarding housing needs - not general. I can't just give them a copy of GP notes, that's not acceptable.

Unfortunately things can change re housing and benefits so if you're wanting a council property you are going to have to jump through these hoops. Would your gp not provide more evidence if you pay for their time in doing so?

I know things change but I can't afford to reapply again even if I was willing to risk my data. It's feels unfair I cannot afford to be on the register even if I was willing to risk identity theft again.

They require consultant and physio reports as well they won't only accept GP letters as they're not independent. GP won't do anymore anyway as they cost and they know I've no money to pay again especially as they just get thrown away - I don't have £90 to waste on a GP letter. The last one was binned as it was only from GP. My GP surgery won't waste money on consultant referrals just for the housing department and, even if they did it would be at least a year before I was seen and I'd need to pay for those letters (assuming they'd see me locally which isn't likely and I can't travel) as well (which is over £100 a page) which I cannot afford to do.

Never mind. I can't do anything about it. Housing association properties here are very expensive anyway because of high service charges and I've no one to be guarantor which I'd need as well so even if I did it I'd likely get nothing anyway - it's a lot of money to waste, again not to mention wasting GP and others time.
