Form E: bad behaviour

I understand that only very serious bad behaviour is counted and that it can backfire if you put something that the court can’t take into account (from what I’ve read). Could anyone tell me if it is worth putting any of the following down please?:

  1. XH would not open post and got himself into a lot of debt, the extent of which I still don’t know. Bailiffs would turn up at the property and he was nearly jailed for not paying his council tax.

  2. he has let the property fall into a state of disrepair. The cellar room (an extra bedroom) was tanked before we bought it but apparently, it failed at some point. The room flooded but he has left it like that for at least a year. I believe this will negatively affect its current value.

  1. Is worth putting in as it has a clear financial effect. Not clear cut though either way. It may be taken in to account, but it depends on what he spent the money on.
  1. Is far softer. Did he have the finds to repair it? Did you? I'd leave it out of that para in the Form E unless there's more to it than that.

The property was well maintained when I was living there with him, it’s since I left. The gable end needed repointing 12 years ago when we bought it and it still hasn’t been done. He should easily have had the funds - he had £20,000 alone in an ISA when we separated. There’s other stuff like the fact there’s a sapling growing right in front of the front door! He just doesn’t take even basic care. But I will leave that out if it’s not going to be taken into account.
