Redundancy question

Hi all. If an employee is offered a new role with less pay on basis old role (which was never clearly defined) no longer exists, and the new role isn’t accepted, is that a redundancy situation?

is the role different?

TittyGolightly · 11/09/2018 07:20

If the new role is considered to be “suitable alternative employment” then no.

cloudtree · 11/09/2018 07:46

But its less pay and so the new role is not likely to be suitable alternative employment.

However, it could be that the employer is actually trying to reduce pay for what is effectively the same role. In which case no redundancy would exist in the first place.

So is it the same role with a few tweaks or is it fundamentally different?

It’s the same role with a few tweaks. I know this is out of context but it’s goimg from being a Programme Manager to a Risk and Audit Manager. Using exactly the same skills and experience.

In that case its very difficult to say whether its redundancy or not with this level of information. If the role wasn't clearly defined and you accept that it is the same role just with a few tweaks then what they are really doing is trying to reduce your pay for the role. How long have you been employed?

As cloudtree says, if it is less pay it is unlikely to be suitable alternative employment so this would be a redundancy situation. However, if the new role is essentially the old role with lower pay the employee may have a claim for unfair dismissal.
