Liable for Actions of an Ex-employee?

I work for a voluntary sector organisation. A full time member of staff had a falling out with one of our freelancers over a project they were both working on.

The f/t member of staff left recently, and we are continuing to work with the freelance on the project.

The ex employee has seen this on various social media and is harassing the freelancer, making comments on social media and sending aggressive / inappropriate e mails.

Do we have any residual liability or responsibility for this? Are we within our rights to tell her to stop it? It is still centred around the project, and our organisation, as would be clear to people who see it.

Any advice on our legal position very gratefully received, thank you.

You do not have any liability for the actions taken by your ex-employee once she left your employment. You are not responsible for her actions. You can ask her to stop but she is entitled to ignore you. If her posts are libellous you can get the social media provider to remove them. Your freelancer may also be able to report her to the police for harassment.
