Another GP rights one. When the father already has a CAO for himself.

A question for a friend as I'm not sure what to suggest

If a NRP has a CAO for their dc ( the ex was being awkward so it had to go that way, and the NRP got what they requested.)
The non resident parent has EOW with the dc and 3 weeks a year holiday time. The NRP parents (Gp) want to see more of the dc, however with time so little and distance to travel there's not mucg time to take them.

NRP parents has requested from RP some time. One night a month on a weekend. And some time in holidays.. RP has point blank said no and do it on NRP time.
The dc don't want to miss time with NRP and is always asking to sleep at their gp house.
Would it be worth asking for GP rights.

It would be a lot of travelling for dcs to do on NRP weekend.. Due to where NRP lives, but the GP live near the RP so wouldn't be bad.
If not I guess he will just have to juggle it

One weekend night a month sounds a lot when the dc are only home every other weekend as it is.
Can he not stop at his parents with the dc once a month?

I agree with the RP, the grandparents should see the children during the NRP time with the children.

The children can see the NRP and grandparents at the same time, so in what way is that missing time with the NRP? The children could sleep at the grandparents during the NRP time.

Giving the grandparents an additional separate weekend means that the RP will do all the work, school drop off etc, while the NRP and grandparents have all the fun weekends, how can that be fair?

No that's ridiculous, it's each parents responsibility to facilitate relationships with their respective extended families on their own time if they so wish. Absolutely nothing to do with the RP and rightly so.

There are no automatic grandparent rights unfortunately for your friend. The GPs can apply to court for leave and then pursue court-ordered contact if the leave application is granted, but they would need legal advice.

Yeah that's what I was leaning towards to be honest.
I know with my dp we make sure the kids see their GP in his time. Likewise my dc see their other gp in dad's time
I did suggest an afternoon a week from school.. Would save RP on after school fees as I belive she works until evening. They could give tea and take home. Then doesn't cut into mums time?

If the RPs parents started demanding contact on the NRPs time would that be considered fair? Of course not and it’s the same the other way around. It’s for the NRP to facilitate contact with their family on their time.

Well if she wont be happy to not see her kids evenings and most weekends.
You could be onto a good idea about the after school/helping thing. But I expect they've blown it by asking for way too much at the start.

The logical approach seems to be for the grandparents to utilise some of the remaining 9 weeks school holidays the kids have each year (one parent seems to only get 3 weeks), so simple enough to ask for an additional 2/3 days each school holiday - three half terms, Easter and Christmas. Holidays are normally split in a CAO 50/50, so the request would be reasonable.

The parent with a spend time with order can then let the kids spend those additional days with their grandparents.
