Dodgy solicitor

I need advice please. Back in January I made an appt to see a divorce lawyer. I cancelled it, rearranged and then cancelled again. My husband and I needed our marriage and all was fine. However, turns out solicitor is an old mate of husband and has just told him I'd made appt to discuss divorcing him. Obviously our marriage had hit the rocks again. Surely there is a code of conduct? Does anyone know

You were never a client though. Albeit the lawyer would have been wiser saying nothing when he made the connection...

I think you have a reasonable expectation that would remain private. You would be within your rights to complain.

The SRA Code of Conduct covers both actual and prospective clients when it comes to confidentiality. He should NOT have told your husband and could face disciplinary action by the SRA if they knew.

You need to make a formal complaint to the firm, that’s completely unacceptable.

I am a solicitor. The fact that you did not instruct this person is not relevant. What you told him was confidential and his conduct breaches his duties under the solicitors' code of conduct. You can't put the genie back in the bottle but you can complain to the Solicitors' Regulation Authority about the breach of confidence.
