Daughter now wants to live with me

Hi all,
I’m looking for some advice in relation to my Daughter.
Several years ago myself and my Daughter’s Father divorced which was very messy involving court.
In the end it was granted I would have residence of our daughter but my ex would see her 3 nights a week.
Fast forward four years and it looks like another court date shall be soon .
Our daughter is now 12 and the past six months she has been enjoying it less and less going to her dads.
Causing her distress and upset.
It’s now escalated to her not going back at all due to numerous arguments between her dad and her and him being very aggressive towards her and myself at my home.
I am now seeking to get the current court order changed as my daughter simply isn’t happy.
I am there for asking if anyone has gone through similar and roughly how much did it cost?
Please note I am not for one minute stopping my daughter from having contact with her father just listening to her wishes and am keen for her to still visit.
Any advice would be brilliant.

As your daughter is now 12 it is likely the court will order a s7 report so that CAFCASS can speak to her to ascertain her wishes and feelings on the matter. She'll be able to write a letter to the judge if she wishes. Both you and her father will also be interviewed for your views.

It would be preferable if you could try mediation (some mediators work with the children too) but if the father is being aggressive and bullying, that may not be the best option.

Cost to issue a variation application is £215. Any other costs will depend on whether you instruct a solicitor or self represent.
