Disability discrimination?

A few weeks ago I had my employment terminated, had been there since February, had no indication there were any issues, just went in one day (less than a week after travelling to London for 2 days training) and that was it.

I raised a grievance as I felt I'd been treared unfairly - it's a small company c65 employees and I knew of at least 2 other people who had probation extended due to performance so I felt I had been treated differently, only reason I could think of was because im physically disabled.

I went for a meeting, or should I say character assassination last Friday, I left after 15 minutes as I wasn't getting a chance to address the issue it was basically a list of any tiny error I may have made, along with lies about me not producing reports which I had but of course can't prove I did - none of those supposed issues were ever fed back to me while I worked there.

One thing they stated was that I relied too much on written communication (IM and email) rather than going to talk to people - well that would be because I can only walk short distances using a stick due to my disability and it causes me pain - in fact some colleagues would tell me not to walk over to them! This has cemented my belief that my disability was a factor.

I have legal cover with my home insurance, have never claimed on any policy in my life before, do I just call them to say I need a lawyer?

I want to make sure they don't treat anyone else as unfairly...

I'm afraid as you were there less than 6 months. They can get rid of you for any reason..
don't think you have a case. sorry!

Wauden · 14/07/2018 23:26

@Amaried, out of interest, what is the significance of 6 months?

AudiQ2 · 14/07/2018 23:44

@Amaried WRONG!

Disability Discrimination comes before anything. I was fired because of my disabilities from Curry's Pc World 3 weeks into my employment and won my case! Didn't even have to go to court!

Call ACAS! They will do it all for you op

Helloflamingogo · 14/07/2018 23:48

Amaried is talking rubbish, if you’re in the U.K. you can claim under the equalities act no matter how little time you’ve been there.

It will not be pretty or fun, but you have nothing to lose by having a discussion with a lawyer.

Helloflamingogo · 14/07/2018 23:48

Oh and call ACAS.

Wauden · 15/07/2018 00:01

About the reports, there would be a record of the reports you wrote, on the computer, did you have a chance to show that you had written them?

Anyway, I would definitely, look into the possibility of taking it further. Look at ACAS website.

TittyGolightly · 15/07/2018 00:04

Did you formally declare your disability? Did you ask for any adaptations to the role?

Flaminghaggis · 15/07/2018 12:54

Not to derail titty, but how do you formally declare?

TittyGolightly · 15/07/2018 18:13

By notifying the employer formally (by letter).

Flaminghaggis · 15/07/2018 18:52

Does that make a difference to whether you are entitled to support or not? I was under the impression that if they are aware they must make reasonable adjustments?

(Sorry I’m really not trying to be argumentative, I’m disabled myself and it’s not something I’ve done. I have always told employers (once employed, not at interview stage. Arguably I’ve been discriminated against twice in my career but not taken it anywhere).

TittyGolightly · 15/07/2018 19:05

As long as you can prove you have a disability that’s covered by the Equality Act and that you’ve told your employer you’re entitled to reasonable adjustments.

Wauden · 21/07/2018 23:46

So, what happened ?
