changing residency

Apologies if this is not in the right place, still a fairly new member. For long and complicated reasons, my DPs DCs have lived with a guardian for the past few years. They have virtually daily contact with him including overnights during the week and every weekend. Their mum can have supervised contact only but since moving away (different country) has telephone contact once a week. My DP now regrets not pushing for residency himself and we often talk about him going back to court. For clairty, there were no concerns about DP's parenting, exP would not support the children living with him but accepted the guardian. This also meant DP could continue working f/t to provide for the children. Would a court view residency with a parent preferable? We don't currently live together but are planning to.

Good question! They are often upset to be going back after a weekend with Dad, to the point that one of them will often end up staying an extra night with Dad despite the very early wake up as DP has work the next day (he starts at 7am). They each say they want to live with Dad too. Not sure how much is a genuine wish and how much is a way of saying 'I love you Dad' (like not wanting to leave a great holiday destination).

Can you get them an advocacy worker? It’s an unbiased person to speak to the children alone and get their views and feelings. I did it for DS1 when his dad and I were going through court as I wanted him to be heard, but not pressured to say anything he didn’t really feel. I wanted him to be able to speak freely, and give his own thoughts and feelings.
