Do I need a solicitor to transfer my share of ex DH's business back to him?

He's a contractor set up a business to trade under. Its just him, and he appointed me as 20% shareholder years ago. We are splitting up and I have no interest in remaining a director. I am failry sure I can just resign the directorship in writing to exH and to companies house. But how about transferring shares back to him? I will get a lump sum payment for giving them back so happy to do so. Will this need a solicitor? TIA.

I did this a few months ago. Just resign from the company and accountant will send you a share transfer form to fill out and that's it, he needs to inform companies house of the changes, accountant can do it too. You don't need a solicitor.

Yes, your accountant can do it

You need advice to ensure you don't get stuck with liability for capital gains tax, the accountant can advise.

And you need an indemnity in your financial order from your ex in relation to any claims arising in relation to the company before and after the transfer.

Please get a lawyer to approve the order.
