Quick question please

This morning a woman driving knocked DS off his bike. Witnesses confirm it was her fault - she turned into him without looking. He's thankfully OK but his bike is a wreck - she carried on driving over it and into a bush.

Is this something we could claim via her insurance? It's not a massively expensive bike but it's not something we can replace right away.

It only needs to be reported to the police if there was an injury sustained. Damage only RTC do not require the police to be informed at all.

Thank you. Just getting him checked at the walk in as he banged his head (thank feck for helmets) but hopefully he's ok.

That is not correct.

If you are driving a motorised vehicle, are involved in an accident and fail to give your details to anyone with reasonable grounds for needing them you must report the accident to the police regardless of whether or not there was an injury. If there was an injury you are only required to report to the police if you don't produce your insurance certificate for anyone at the scene with reasonable grounds for seeing it.

In this particular incident, the OP can report the incident to the police if the driver did not give her details at the scene as the driver would have committed an offence regardless of whether or not anyone was injured. And she can definitely claim the cost of the bike from the driver's insurance.

DH took the woman's details (accident happened fairly close to home & he went down to pick DS up) so we'll contact her again later about the bike. Thanks to all for help & advice.

Just a very quick point, as he sustained a head blow you also need to replace his helmet which you should claim for too

Thanks @Schroedingerscatagain - good point. He's got a spare but we do need to replace. Just been to the bike shop and it's a definite write off. The back forks are all bent & torqued in. They're going to write us a proper accident report & replacement valuation.

Make sure you have photos of the bike and helmet before discarding.
I would claim for losing a day's work, if he is not being paid.

I’m sure if you contact her she would be more than willing to pay for a new bike, if she offers I would go for it rather than go through insurance that can take ages and you may not get as much as you would hope for a new bike( any reasonable person would pay up anyway).

DH has just spoken to her. She's more than willing to pay for a new bike and helmet. She's admitted it's her fault. She thought he'd cleared the junction. He's only 12 so we don't need to claim about lost pay, I've got annual leave so I've just taken the day from that.

We've taken photos of the bike & his bruises in case but it sounds like she wants to deal with it between ourselves.
