How do I do this please? I have consent from all with PR, and I want to use the new name on a passport too.

I wouldn't be able to afford that x4. A solicitor today suggested applying for a court order as it would be cheaper and they only have to get cafcass to call and him send a statement to say he consents rather than attend etc.

What forms would I need for that and PR application?

Thank you very much. I get court orders for free due to my circumstances.

I have phoned 4 solicitors today and they were all very confused and couldn't give me a price without charging me £185-£205 an hour upfront.

We both agree to PR and name change, there is nothing to mediate, mediation said we didn't need to go, I called them today also. Do we have to go, even though we agree? Seems like a waste of time.

It is, my husband, we've been married 6 years now and together 7 so I think that shows we are stable etc and he is in it.

I agree. You just need a simple change of name deed. Not even a statutory declaration. As for the PR agreement, follow what FLS has suggested.

Do we need to do an Affidavit and have a declarant we've each known ten years? Because the logistics of all that and cost won't be possible.

Can I use a normal deed poll for passports? We have no travel plans but you never know what the future holds. I have read a lot of parents can't get passports in their Childs new name with just a deed poll.

  1. No. It's not an affidavit. It's a deed (where names are witnessed). On a recent thread about this (there seems to be at least one a week) someone posted a link to a free one. Here is a link to another www.mdpryke-notary.com/2010/08/changing-name-by-deed-poll/ This is precisely the deed I'm referring to, though it is for an adult not a child. The owner of that website still falls in to the trap of calling it a deed poll. It isn't. It's a change of name deed. Download this document in the link, fill your details in, and that's the document you need. You will need to amend it so that the deed is made by all those with PR, and you are making the deed so as to change the name of a child, A (mention their date of birth), for whom you all have parental responsibility. The child doesn't sign it. You'll have to amend the signature clauses accordingly.
  1. You can use this for passports.
  1. Make a few originals - you will need them to send out to banks, passport authorities, schools etc. If you only have one you'll have to go to a post office or solicitor and pay for copies to be certified.
  1. Someone not related to the child can be the witness.

Follow the link for FLS above - that is for the change of name deed for a minor.

As your child is a minor, you are the ones signing the deed - you have to change it on your child's behalf. Only one parent has to do it, but it can only be done if both parents are in agreement.

If only you is going to sign the deed:-

  1. Get anyone else with PR to write a letter to you to confirm they share parental responsibility and agree to you changing the child's name from X to Y. You don't need to do anything with the letters - just keep so that if someone challenges it in the future (which is unlikely) you can prove you did have the needed consents.
  1. Once you have the letters from the other parents, fill in the deed on the link and have your signature witnessed. It has to be an independent witness (adult over 18, has mental capacity, not related to you, child or anyone else with PR) - usually an adult friend, colleague or neighbour works well.

If you want and there are two of you with PR you can both sign the deed. You won't need to do step 1 and both just sign and have it witnessed. From the way it is done, you can both sign separately - you sign and your witness completes the bit underneath, post it to the other PR for them to sign with a witness (you don't need the same witness). They can then send it back to you and add the date at the top once you have both signed.

Once you have signed the deed that is it. You can enrol it, give notices etc but you don't have to and solicitors who deal with change of name deeds usually don't.

You just show the deed as evidence of the change of name. If your child has a passport apply to change the name on the passport first (you will have to send them the deed). Once the name is changed on the passport it is so much easier as you can just show your child's new passport to everyone as evidence rather than showing everyone the change of name deed.
