Work trying to implement weekend working

I am looking for some advice please.

Basically our work is trying to implement weekend working. They don't want to change our contracted hours, just the days we work them. Does anyone know where I stand if it's not in my contract? I currently work part time over 3 days and they want me to do Sat Sun Mon as my turn of 1 in 6.

Today was day 1 of a 45 day consultation process and they want it to start mid June

Thanks in advance for any advice anyone has

Your contracted hours are not just the number of hours you work. It also covers the days and times at which you work. This is a change to your contract. I suggest you read this leaflet from ACAS.

An employed cannot unilaterally change an employment contract. It needs to be negotiated. Get some advice.

PersianCatLady · 02/05/2018 18:22

How long have you worked there?

PaddingtonBearHardStare · 02/05/2018 18:57

Do you have a union? if your employer recognises a union for consultative purposes then they will be involved in this whole process. Your contract cannot just be changed without your permission. However - if the employer can prove their business requirement for particular hours/days to be worked then they need to negotiate with the staff. The opening of consultation is your chance to say why it would not work etc and more importantly why the change would not work for YOU. Worst case scenario is that it is imposed (usually because of no reasonable objections) and if so, then the staff would claim that it was not suitable alternative employment for them. This would usually result in a redundancy or severance offer.
Basically, consult your union. Please don't tell me there isn't one..........??!

Sunny there is one but none of us are in it. I have never had any problems and didn't envisage this now. My direct manager had told me I was covered for so long under my existing contract and we found out today this isn't true.

I am going to look at the small print tomorrow of joining now and getting help even though we've had the initial consultation. We have been offered the help of a rep but she has been pushed at us so hard it is making me suspicious and I would rather appoint my own if I can

Be careful

In one of my previous jobs it was a signed contracted hours/days.

However with 28 days notice they could change our hours/days.

Of course your place may be completely different and I hope it is. But just be careful

prh47bridge · 03/05/2018 22:10

Chippyway - They can do that if it is written into the contract. If there is nothing in the contract they need your consent to change hours or days.

I don't have a copy of my contract, I will have to ask HR for a copy
