So I’m now 2 years separated from ex. We have no financial ties. We were renting but house is now in my name only, the deposit is in the scheme with both our name on it, is the only problem? I have things he will probably say are ‘his’ eg tumble dryer was put on his credit few years ago but then at the same time I bought a large washing machine and large Fridge freezer that I would’ve have bought if he hadn’t moved in. Never shared a bank account or credit card.

I can’t afford a solicitor, we have no dc. Will it be ok just for me to download the paperwork, complete it and send it off? are there any possible things that could arise and bite me on the bum?

Tia

Your financial claims, and his, will be kept open. Doesn't sound as if it's going to be too important though. The main thing it will affect is that he's going to be entitled to half of the deposit back.

Just make sure you don't win the lottery.

Make sure you look at a clean break agreement, then if you do win the lottery he can't claim any!

A clean break is what I want.... would that be simple to get? Do you just ‘tick a box’ on the form?

No. You have to read up a draft order, and a form called a statement of information, and submit it to court. You'll need a solicitor for that part. We offer a fixed fee, as do many other firms.

I don’t want him ever having access to anything of mine (not that I have anything, I just have debt and a LP with disabled dc) you just never know what the future holds. So I have to go to a solicitor to arrange a clean break? Do I just ring one and ask what they would charge? There’s nothing else to dispute, only the information above. Will it be simple though? I can’t afford a solicitor so would have to have a set fee and use a credit card...

do you have any idea roughly I should expect to pay collaborate? Iv looked at the help with fees section and in my area we don’t have universal credit yet, I’m still on child/working tax credits, I work but only 16 hours minimum wage... do you know if this would qualify ?

I've sent you a PM. You'll have to see if you qualify for Legal Aid on income grounds by going on to the LSC website. checklegalaid.service.gov.uk

Mine was years ago and similar finances. I printed the divorce papers off the government website and did those myself and then paid online for the clean break agreement. The Court staff were very helpful. My exhusband did I think in the end get legal advice to look at the clean break but it was all above board. Hope you manage to sort your out op.

ran how did you do that? I’m a bit worried about online stuff as iv read of cases where things didn’t end up legal!
