Posting on behalf of a friend.

Her and her ex husband have a child arrangements order. In the order it states no pictures of the 3 children on social media.

Tonight she's received a text off her ex husband, informing her she's in breach of the CAO because she's named the children on her social media status.

She responded that she was only aware no photos allowed.

He told her she's incorrect that its common knowledge that a child under a court cant be named and because the children are under a court order they cannot be named nor their pictures on any form of social media platforms at all, and that he will be informing his solicitor.

My friend represented herself all the way through and is now panicking she has breached the order.

Can anybody shed any light on this situation? Has my friend actually breached the order or is her ex husband incorrect?

Does she not have a copy of the court order? Tell her to check the wording.

If the order simply states no pictures of the children she has not breached it.

The prohibition to which he refers (but clearly does not understand) is that you cannot publish information that allows people to identify that a child is involved in proceedings under the Children Act. If someone does so they have not breached the order, they have committed an offence. However, as the proceedings are over and a court order has been issued that prohibition no longer applies. Even if proceedings were ongoing, there would be no problem with your friend naming the children as hers on Facebook provided she does not also talk about the court case and provided others have not identified her as being involved in the case.
