How long after filing until action?

I am suing my ex landlord for non protection of deposit which he also refused to return. Have done everything, letter before action etc to no response. I have sent my evidence and statements to the county court. I have no chequebook and rang the court who advised to leave a note and my phone number so they could call me to pay by debit card. They haven't yet. When they do how long will he before the case is allocated and starts? Thanks in advance.

Can take a while for the court to process claims. Depends on work load and which court you issued in. Don’t wait for them to call you to pay the fee, keep calling them or pop down again. All else fails, they may take cash?

Sorry if this is a stupid question but have you filed a claim form? If so, how long have you been waiting?

I wouldn't recommend this now if you've already sent stuff in but there is a way to make a claim online and you can pay by card when you do that.

Yes, 3 copies of the filled in claim form sent too. It's not a moneyclaimonline so I can't file online - am suing under the housing act so it's the N208 form.

I don't live anywhere near the court anymore - it was his local court and local to the rental address so I can't just go in unfortunately. I'll give them a ring today.

Yes, give the court a ring. It's amazing how often things get lost or sat on. When I was last doing litigation a couple of years ago the county courts were operating a system where they would pass on all new claims (regardless of where the claim forms were sent) to the Northampton County Court for the acknowledgment of service/defence stage, and then transfer them to the local court afterwards. I don't know if they're still doing that. But try the court where you sent the papers first and I'm sure they'll tell you if you need to ring Northampton instead.
