Could someone help me with what/if any act this falls under? Company agreeing a refund then changing their minds the next day and refusing to communicate?

Would it come under the Consumer Rights Act 2015 or the Unfair Trading Regulations 2008. Or neither of these? Please tell me there is a law on this?

The company has agreed in writing that they offered a refund, then changed their mind the next day and decided to try and repair, but never provided any details of the repair or the problem they found and now just say, it’s fixed come and get it.

Please tell me I have a leg to stand on as I’m banging my head against a brick wall here. I just want my refund they agreed too!

You need to be a bit more specific. Did you pay for the item by CC? Could you use a section 75 claim? How much is the refund? Is it worth issuing a small claims?

It sounds like contract law. If a refund was agreed and you have that in writing that's your contract. However, if you agreed to the repair afterwards you might be stuffed.

The Consumer Rights Act states that a company has the right to try to repair or replace an item before offering a refund.

They may be in breach of contract by withdrawing their offer to refund, but was there consideration (so was there a contract in the first place)? And if there was, what's your damage been? They say they've now fixed it so what have you lost from that breach?

Why don't you want it now?

It's simple contract law.You need offer and acceptance. Did you ask for a refund and they said yes? If so, you have an enforceable agreement.

Thank you all! Sorry not to be more specific. I asked for refund, he offered a refund of 75% of the cost, I was like what? Absolutely not (he can’t do that anyway I’ve since discovered) the next day he says I’ve fixed it come and get it (I highly doubt he has fixed it) and refuses to communicate further. Apart from to confirm in an email that he did offer a refund but then he’s changed his mind and it’s now fixed.

But he never offered the refund that you accepted. So it all depends on when you bought it, and when you returned it. There are strict time limits in which you must return faulty goods for a refund, and after that the seller can at their discretion effect a repair.
