Hi, my daughter rents a top floor atic flat I'm bath, yesterday she fell down the stairs and fractured her arm in two places.
Thank God it wasn't worse.
Basically I'm asking do you think she has some kind of claim on the landlord. Tia

What do you mean "flat im bath"?
What kind of claim do you think she would have? Are the stairs unsafe for some reason?

ToEarlyForDecorations · 04/03/2018 10:44

I think it's means the flat is in Bath. Curse of autocue strikes again !

Don't know. CAB/Google could be the first place to look. Or those ambulance chasing, 'been injured in an accident that wasn't your fault' type organisations.

Purplerain101 · 04/03/2018 10:46

I think you would only have a claim if the stairs could be proven to be unsafe (dilapidated, very steep with no handrail etc).

Hoppinggreen · 04/03/2018 10:49

Was the staircase unsafe and had the Landlord been made aware of this by email or in another way that can be proved?

Psychobabble123 · 04/03/2018 10:51

Why would the landlord be to blame for your daughters accident?! Unless the stairs were damaged, but you don't say so....

TheHodgeoftheHedge · 04/03/2018 10:53

Why on earth would she have a claim against the landlord over a simple accident?! I hate this "sue" culture.
Accidents happen. It sucks. Get over it.

Unless of course the landlord did something deliberately negligent which you will inevitably drip feed to us shortly.

OurMiracle1106 · 04/03/2018 10:54

Unless landlord was aware of repair issues and hadn’t taken action swiftly then no she doesn’t have a claim.

If she fell down the stairs it’s human error so long as they were safe.

Redglitter · 04/03/2018 10:55

Why would you think she had a claim? Unless there's more that you're not telling us then it wasn't his fault she fell.

pumpersnatch · 04/03/2018 10:59

Was there an existing problem with the stairs that you had informed the landlord about? Had they ignored it?
If not of course you don't " have a claim " !!
Would you expect her to sue YOU if she fell at home?
It was an accident get!

What would you be sueing for anyway?? Will she lose thousands in loss of earnings? Will she have to abandon a lucrative career? Will the incident change the course of her life???

Hmm
LIZS · 04/03/2018 11:02

Sounds like an accident, unless there is a history of poor maintenance or it is not a proper conversion meeting buildings regs.

PestoSurfissimos · 04/03/2018 11:04

Well it would be a good way of losing your daughter’s accommodation. Unless of course that’s what you’re aiming for....

Ceebs85 · 04/03/2018 11:07

What everyone else said. Need more detail. Is he somehow at fault for her accident?

BeeFarseer · 04/03/2018 11:08

No. Hope that helps.

Angrybird345 · 04/03/2018 11:16

How is the landlord to blame?

Kidssendingmenuts · 04/03/2018 11:27

Unless the stairs and carpet were unsafe you don't have a leg to stand on. If they were unsafe had she flagged it up with the landlord also?
Maybe teach your daughter the importance of looking where she is going.

specialsubject · 04/03/2018 21:19

There is a theory that stairs would never be allowed if invented now.

Nonetheless if something broke under her, there is blame on the landlord if he could have reasonably known about it. If she was drunk, wearing stupid shoes or just fell - life lesson.
