Will I go to prison

Hi,
So I’m 19 years old and I got caught with fraudulent receipts.
So I created fake receipts, with stolen items on them. Then these items were returned by me and someone else. It would at least be £200 worth of this. I told them I had done it because they had CCTV of everything and it was so clear I couldn’t deny it. They called the police and said that the police would come to my house or call me soon which could be any day. Maybe today, tomorrow, weeks, I don’t know.
This is the first time I would be in trouble with the police, and I go to college.
Would I be sent to prison for this or what else would happen?

toearly. I'm not a security guard. I'm a police officer well aware of the response times to non urgent incidents.

Dealing with it at a later date is perfectly normal.

Unemployable, absolute crap.

I have never had a police check in any of the jobs I have held, all in private sector, one in an employed position for a charity. I have also throughout my career been responsible for employing many people and have never asked for a police check.

This is the trouble for asking for advice on the internet, a little bit of vague info plus a large amount of opinion goes a long way.

Well we were done with the investigation interview at 12:30 and she said just so you know the police have been called, they may come today if not they will contact you or come to your house, and I would’ve left at 1:30 so the manager made me wait until then. They didn’t come so I’m guessing the police were busy

Most jobs don't require a dbs check ( under rehabilitation of offenders act) you can google a list of jobs that would need one

I've been reading many people who are caught stealing from primark are contacted by RLP instead of the police, which avoids the court system but instead punishes people with large fines and bans. Hopefully this will happen to you.

There is a lot of unqualified crap being spoken on this thread.

OP should be taking notice of what people with Direct experience or knowledge of the situation such as police officers, solicitors, court workers and magistrates are saying. Plus taking note of actual factual guidelines as linked.

Posters simply stating “you won’t go to prison OP” etc without any factual basis or direct relevant experience are just wasting space frankly.

Good luck with business .. I have 2 degrees, 7 years of part time work and multiple extra curricular and extra qualifications including shorthand and BSL and it took me 6 months to find a decent job.

Try not to worry OP. They may not have called the police (I know they said they did).
You won't go to prison and a background check is not forever either. I have had lots of jobs and only one required a background check as working with children.

OP, regardless of my personal opinion on your actions, if your employers pursue a criminal justice route, then the police will ask you to attend voluntarily as you pose very little risk to the public.

Again, if Primark decide to pursue, then you will be interviewed under caution. Please do ensure you exercise your right to a lawyer. Do not do what many do and be interviewed without a lawyer. You will be offered one.

Will you go to prison? That all depends on the pre-sentence report. However, as a former prisoner myself (who did go to prison for a first offence of fraud) fraud by misrepresentation and obtaining money by deception is a a serious offence.

Make sure you instruct a lawyer for the interview. You will bailed to appear at court and you should instruct a solicitor for the hearing. Find a reputable defence lawyer. If you plead guilty, it may well be the Magistrates (because fraud is serious) commute to the Crown Court if the sentence guidelines are outside of the powers oF the magistrates.

Unlock Charity do some fantastic advice so worthwhile having a chat with them.

As for the 'criminal record' Yes, (I have one) I always disclose when asked even though mine are spent now. I have also managed to navigate the barriers with being open and transparent about my background to avoid employers having to go through the mill.

Please make sure you instruct a lawyer at the interview.

It may be that Primary decide not to pursue and end your employment under gross misconduct.

Unless of course, their investigation uncovers other matters, as you're currently suspended, I'd wait to hear from HR.

I have posted advice on your other thread. I would strongly advise you to get this thread removed especially as you have identified the company involved. Your posts show no evidence of remorse - this will count against you in court if they are seen.

The OP only realized they had done something stupid when they were caught. They only admitted to it because their employer had CCTV evidence.

OP throw yourself at the mercy of the court, maybe you’ll get off with a 7 yr transportation to Botany Bay. Sorry Australia.

Court will think it's worse as you abused position of trust with stealing from your employer rather than from a random shop where no relationship

Doubt you will go to prison if it's a first offence but this is probably your first and last chance.
