Deed of variation

Help! My gran's will states that all assets are to be sold. We know that isn't what she wanted (she has said where she wanted certain items to go but there isn't a codicil and we know that the company she used were terrible - we had to get other documents redone.) Can we use a deed of variation to change this? Who gets the residue won't change, just that some items will go in place of money.

If she is alive she needs to do a codicil to her will.

She's gone sadly.

Are all beneficiaries agreed, and over 18?

Who is the executor?

MipMipMip · 27/01/2018 19:17

Executor is not a beneficiary (laymen not pro) and everyone is over 18. Its literally a case of not selling everything off so we can keep some individual items. And give things like clothes to charity rather than trying to sell for a profit.

Don't know why they idiot company put a rarely used clause that wasn't requested in but they messed up everything else so I'm not surprised!

If all the beneficiaries are adult and agree they can direct the executor not to sell. Bear in mind that if there are debts a sale may be unavoidable. But if you can all agree who gets what just write it down and everyone signs it.

Great, thank you!
