We have an overhead electrical cable in our garden which supplies our house and one neighbour before terminating. We have a Wayleave in place which covers this cable going through our garden. We can terminate it - but, if we do so, we lose our electricity supply, so that's not going to happen.

We are currently planning an extension and need to have part of the electrical cable laid underground to allow the build. The initial estimate to have this done was approx £5k which we were happy to pay. Today I have had a call from the power company saying that they will underground the cable at their cost but we need to have a Deed of Grant of Easement against the title deeds for the 1 metre wide trench that is required although we must pay the solicitors fees for this (but it will cost significantly less than £5k).

We are allowed to decide the route of the underground cable through the garden, would like to cut the cost of the extension if we can, don't want to alter our extension plans, and see this as our forever house so it seems like a no-brainer that we accept - but can anybody highlight any legal downside to accepting this offer?
