Can you refuse to act as executor?

I am NC with my father and have been for a number of years.

As far as I am aware neither I nor my DC's are beneficiaries of his will, and I wouldn't have assumed otherwise.

However, I've been told by a family member that he has stated that I am to be executor of the will. I'm not sure if I'm the only one, or 100% sure that this is true.

When the time comes, can I refuse to be an executor? It's not because I'm miffed about not being a beneficiary, I'm truly not, I honestly do not wish to revisit the past.

I am assuming that a solicitor can be appointed instead?

Yes, you can 'renunciate'. Am guessing you need proof that you are named Executor, a solicitor will be able to help you.

Yes, you can renounce it. My mum did as she was named as my dad's executor and she couldn't cope. She nominated me but am sure a solicitor would be happy to do it as they get a % of the estate. I think DM called one of the Probate offices and they sent her a form to renounce it and a friend witnessed her signature. If you plan to use the solicitor I'm sure they would help you get the form. I think DM had to confirm in the form that she hadn't started any of the probate process before she renounced the executor role.

Thank you both, I'm relieved to know that, I'll look into the probate office and a local solicitor.
