My ex husband is in the process if purchasing an equestrian house in Devon. The marital home is in Hertfordshire

Our older 2 children (almost 19 and almost 17) are going to Devon (and the horses)

Our youngest two are staying here (13 and almost 4)

Can my ex take our almost 4year old to Devon whenever he likes? We both have parental responsibility

He has already told me that his solicitor has told him there's no maintenance payable as we are having two children each. The older 2 have both left full time education

How do I deal with this?

Get your own legal advice. Maintenance doesn't cancel eachother out.
Without a court order, there's nothing to stop him taking the 4yo but nothing to stop you refusing either - except, hopefully, two parents with morals who put the child's need to have a conflict-free relationship with both parents first.

I very much doubt his solicitor told him there is no maintenance payable. I suspect he's making it up. He is wrong. As your older two are not in full time education there would normally be no maintenance payable for them. Even if they were still eligible for maintenance, it is calculated based on the absent parent's earnings so unless your earnings are identical it still wouldn't cancel out.

Agree with AliceTown that you need proper legal advice, especially if he is going to play games like this.
