As a witness, is my info kept private?

Hi. Witnessed a car crash the other night and offered to give a statement. At the same time, the driver who's fault it was was quite intimidating and angry when I said he had been speeding. I'm worried that if I make a statement, the guy might get my info and could cause trouble?! Am I just right silly and will the insurance (the innocent guy) keep my info private?

In my experience, no. The police wanted a statement from me after I witnessed a violent crime in 2011, but said thet as part of it they'd give my details to the people being prosecuted. As they only lived round the corner and I was afraid of them (after what I'd seen) I refused to give a statement and the police gave me a hard time over that. Sorry.

The only detail that can legally be disclosed - and has to be if a case goes to court - is your name.

Your address, date of birth, phone number etc are held confidentially.

I was a witness in a case that went to Crown court ( assault)
I'd made a statement obviously but then had moved before the case went to court
I did not want the offender,s or indeed the victim, to have my new address.
The barristers and police assured me that my address, phone number etc were not given to the offenders, victim or their solicitors.
I appeared in court behind a screen

It's a very serious offence to approach a witness outside of a court case. Even more serious to do anything which could be perceived as intimidation. Pretty much "straight to jail territory".

There are two types of court case though, criminal court is a prosecution and civil court to deal with compensation for damage. As far as I recall in the criminal court witnesses addresses are kept private and not disclosed to the defendant. In the civil court I think the addresses are usually given on a witness statement but there may be scope to withhold them. Maybe talk to the insurer of the driver not at fault. I'd offer them your phone and email address but not postal address.
