Mortgage and title deeds with husband.

I am hoping someone can clarify a situation for me? I moved in with my partner a couple of years ago. We both sold our own homes to buy a new house together but my partners sold first and at the time of applying for a mortgage I still had a mortgage in my name so could not go on the new mortgage. I sold my property soon after and we moved in together and have since married. Recently it was time to re mortgage and we agreed I should go on the mortgage but the mortgage company declined. My DH said they told him I have to be added to the title deeds first (I was slightly surprised I was not already on them). Wanting to move forward with this I have just been looking on line and get the idea that to be added to the title deeds I should also be on the mortgage? I am confused now and would be grateful for any advice from anyone who has been in a similar situation and knows how these things work. I am feeling uneasy.

Yes I suppose I am. Not sure why really.

It's a two stage process; apply for a transfer of mortgage account via the bank, and also transfer the legal ownership of the property into joint names.

Any conveyancing solicitor can do this quickly and easily. Shouldn't cost more than £500 plus VAT.

Also I didn't really want to involve solicitors as in my experience costs can quickly escalate. Although we do need to make will too so perhaps a good idea to start with one from the beginning. I'm uneasy that my husband didn't put me on the deeds from the beginning...

Mumblechum wouldn't it have made sense to add me to the mortgage at the point of re mortgaging?

Would we need a separate solicitor to deal with the wills etc. From the property?

Gamboge, yes but it is good to get agreement in principle before you go to see the solicitors.

TBH you can't not use solicitors to do the Transfer as you have a mortgage and the lenders will insist it's done properly.

Ok that's very helpful, thanks.

nning. I'm uneasy that my husband didn't put me on the deeds from the beginning...

Lenders won't allow that. So he couldn't have done it. Names on deeds not matching the names on the mortgage is something from the ark.

Imagine it from a lender's perspective if a borrower got into difficulties.

Gamboge · 30/08/2017 12:40

Oh I didn't realise that. Just me and my baggage from previous experience then :) Thank you.

Still better to get it sorted out now and consider the conveyancing fees an insurance premium Smile
