Sale of dp's parents house

My dp's father died about 18 years ago, his mum died 8 years ago. His brother still lives in the family home but it was stated in their mother's will that the house was to be left to them both.

My dp has had a really hard time trying to convince his brother to sell the house and had to resort to seeing a solicitor to try to force the sale. The house has now been on the market for about 10 months now and has had a number of people view it. The problem is that the brother drinks a lot and has let the house fall into disrepair and it seems he has no intention of doing anything about it.

The estate agent dealing with the sale said its putting people off putting in an offer. The house was built by their grandparents so it is sad to see it being sold but my dp is having some financial difficulties and the sale of the house would make a huge difference to him. He's even thought of putting the house up for auction but he's pretty sure his brother would block that.

Does anyone know how my dp can resolve this situation, the brother refuses to speak to my dp. My dp can't really afford anymore solicitor fees.

  1. Get an order for sale of the property.
  2. Get the court to make directions as to cleanliness and brother not being present for viewings.
  3. If you get an estate agent to say that it won't sell whilst brother is there, the court could force him to leave.

Surely if the house is 50% your dps then he should at least be getting a 50% value of monthly rent in the meantime.
