Benefit Fraud and Disability Living Allowance - help

I'm seeking clarification on an issue which involves a disabled adult woman who claims Disability Living Allowance, (she gets the higher rate for mobility and the middle rate for the care component)

The problem is she lives with two adult children (non-dependants), both of whom are working. She has been accused of fraud by the DWP as she did not declare them returning home, although she did inform a housing officer at the time, this doesn't seem to have been followed up.

However, according to the rules, she should be exempt under the Housing Benefit Regulations, which state that those who receive the care component of DLA are not subject to non-dependent deductions.

What is the next step from here? If anyone can advise, please help?

DLA/PIP are not means tested and should not be affected by income, or so I thought.

That is correct, there shouldn't be any non-dependent deductions on her Housing Benefit if she's getting some DLA care component.

Are you sure that it is Housing Benefit they are investigating?

Has she been charged with or interviewed under caution for fraud?

Call/email CAB and make an appointment to see an advisor, they will be able to help with this. Your friend will need to take all her benefit information and dates of when her children moved back in etc.
