Prohibited steps order applied for against me... has anyone been through this??

Hello everyone, my ex husband has applied for a PSO. We are about to go to the second hearing (October) cafcass are doing a section 7 report, has anyone any experience with what they ask you?
I am wanting to move from West Sussex to Devon to live with my new partner. (Reason he can't move is because his daughter has a life threatening condition)
I had previously offered to bring the children back every other weekend and pay for his hotel the third weekend (he had the children 2 weekends in one off at present) I have also offered him 8 weeks holiday time..
He has just refused all negotiation and actually asked for less contact than I have offered...
Has anyone had experience with this please, it's costing me a fortune and so stressful

Section 7 is a background check. They ask about your past with ex and do a safeguarding check ( SS/police etc )
( I'm sure you have a telephone interview, I've had loads of reports done due to my ex's abuse, they all roll into one now the different reports Hmm) I definitely know it's a safeguarding letter for the judge.

No, the s7 report is not the safeguarding letter.

It is a full report on all the welfare issues set out in s1 Children Act.

They will interview you both, talk to the child, talk to schools or other professionals if appropriate.

Just be straight with them.

I'm my defence I did get an additional safeguard check on mine more in depth

But your arrangement could so easily change you could become pregent and thus not wanting to travel long distances so could cost him more in the long tern as the CM reduction for travel costs if pitiful like £2 per hundred miles.

But for all likely hood you will get what you want at worst there might be a court irder for you to do the travelling rather then good will

Not a PSO against DH but defended from the other way. application by Dsc mother to remove from the jurisdiction . CAFCASS did S7 on all children. Judge was concerned that this was a way to 'replace' DH in the my Dsc eyes , with Ex W new husband. Removing DH simply by creating distance.

The reasons for going were stated as 'enhanced lifestyle'.. (new DH very wealthy and children being bribed with all manner of fabulous treats 'if they told the Court lady how excited they were to go') Lots of coercion . Ultimately it hung on current contact. That it was extremely regular (not missed a weekend in 10yrs) and that DH had a strong and effective relationship with his dc, that would be seriously disrupted by this proposed move, this decided the judge to refuse the application and she had to stay. We have always offered to have the 2 youngest who live with her (eldest already live with us) so she can go live with DH, but always refused.

How much contact did they have? My children 4 and 6 see the father two weekends on and one off and 5 weeks holiday, I have offered the same contact with extra holiday, offered to travel and pay his expenses for when he comes down. I would hate for my children to lose contact with him. I believe Devon is in the jurisdiction. Where was their mother planning on moving to? Thank you for your reply.

The 'jurisdiction' means the area covered by the court that either made the original contact or cao order. Or the area covered by the court where the specific steps order /preventative steps order is being requested. A PSO being applied for in West Sussex means the Jurisdiction covered by the West Sussex court. Devon is definitely NOT the Jurisdiction. Hence the need to request the courts permission to remove to another jurisdiction . - Devon.

It's not as simple as that though - all that travelling is not really in the dc best interests. The regular long travelling is tiring, tedious, expensive and effects other aspects of family life.
You getting pregnant, changing working hours, illness etc would all effect this. i highly doubt your new partner would be willing to take up the travelling in your place.

As for paying his expenses when he comes down - again the above applies.
Plus he's not getting to spend time with his dc in his own home or be able to do the things they currently do.

you wouldn't be happy about this if it were you in his shoes.

why can't you move somewhere midway for both you and dp?
Or if you want to be with your new partner that badly move there on your own?
How long have you been together?
There's nothing in this proposal that is in the best interest of YOUR dc.

Apologies. Yes you are indeed correct about the 'jurisdiction' I had assumed it was the court area but in our case DH ex was applying to move abroad. So it wasn't simply moving from the area but the country ! . Apologies again.
