Is it possible to leave money to my adult daughter but protect it from going into her 'marital pot'? So that if the marriage breaks down, her (in my opinion, abusive) partner can't get to her inheritance?

Unfortunately not, unless you wish to make a very complex and expensive life time trust such as a family protection trust.

If you die, your daughter inherits, and they then divorce, then her inheritance isn't ringfenced for her, although the court would be unlikely to give her husband half; it's a bit of a grey area, and depends very much on what other assets are available, length of marriage, length of time between the inheritance and divorce, etc etc.

Thank you.

Would a discretionary trust not work in this instance? The daughter would not have an absolute right to the assets in trust so therefore could not be taken into account for marital assets.
