If my tree damages neighbours car/house etc whose insurance do they claim on - mine or theirs?

Just that really, we own a plot of land which we are about to start building on and have had public liability insurance on it whilst it was unoccupied. So now builder insures it as his site, do we still need pl insurance. I thought yes in case tree falls and damages neighbours property but dh said recently a tile came off a neighbours roof and damaged his employees company car and insurance company said act of god, you have to claim off own insurance so dh company ended up paying for damage. So is it like cars and you claim off the person whose property damages yours iyswim or do you claim off your own insurance if damage is to your property? Hope that makes sense Confused. And should we have the pl insurance in case some fecker breaks in to the (securely fenced in site) and injures himself whilst nicking something? Thoughts please TIA Smile

Yes you remain liable to trespassers too unfortunately.

Yes, you still need PL insurance and they would claim on yours

To answer the question in the thread title, they claim under their own insurance unless it was obvious to you as landowner/occupier that the tree was about to cause damage, in which case you'd be liable.

There is no strict liability for property owners to be responsible for what the wind does.

Thanks collaborate - that's what I thought, the builder has pl insurance so that's saved us £350 to spend on something else!
