Can't sell house

House has been on the market for over 7 years and still not one offer and a handful of viewings. The property is owned by DH and his exW. What are the options? Especially since the exW is being very awkward and not wanting to drop the price to the value it has been revalued at. We want to get the house sold, move out and move on.

Thank you so much for clearing this up. The person who made the will is a friend of my husband and didn't charge us. DH claiming to know nothing about how the house is set up. Going to get a copy of the divorce petition now.

Get the severance done too, it's easy enough! Then at least that bit's done.

Thank you we've made appointment with a new solicitor. I assume the ex will need to agree to the severance, what happens if she doesn't?

Not at all, look at the links. You just draft the notice, your husband signs it, send it to her (signed for post) and then register it at HMLR. No need for her consent.

The "Separation Agreement" sounds nice and watertight... it says the house is for sale but doesn't say anywhere how the proceeds will be split?!

It would be irrelevant even if it were properly drafted (who drafted it?) because it relies on your husband being able to apply to the court for financial orders on divorce, and he may now not be able to.

There's a case where a husband married after the consent order was sent to court, but before it was approved: the first wife found out, her solicitors recalled the draft order, and hey presto, that husband lost out on his expected settlement.

The "friend" drafted it! Need to wait until we have all the paperwork back and see what's what. It's looking a bit dodgy!
