Tenants in common

My uncle died last year and left a rental property to me and my brother. We own it as tenants in common.

I would like my half of the house to be jointly owned by myself and DH. All of our other assets (not that there are many!) are in joint names and when his Ddad passed away he used the inheritance money to pay off some of our mortgage so I feel he's left himself financially vulnerable whilst I have an additional asset.

Would it be very difficult to do this and is there anything else I need to consider? If it makes any difference my DBro and I are planning to sell the property in a year or so.

Not particularly difficult or expensive to do a transfer into 3 names, but a bit pointless if it's going on the market soon anyway

If you're married it's all shared anyway, isn't it?

No real point as you're going to sell it in a year anyway.

If you really want to (and assuming your brother agrees) then you'll need a lawyer to draft a transfer deed, and the transfer will need to be registered at the land registry. If you look at the land registry website you can check their registration fees but it's likely to be a few hundred. Add that to a couple of hundred for a lawyer to do the work.

As you're married I think it's not necessary really - ultimately if you split up all those assets would be considered by the court anyway!

Thank you all, that's really helpful. I wasn't sure if a court would take it into account if we divorced so it's good to know that they would. I guess we'll just leave it as is for another year.
