Hi can anyone advise if a paternal grandmother can be given sons PR in the absence of father being in custody?

Only if the child comes to live with her under a court order. The only people who can get PR otherwise are parents or those married to either parent.

I thought my son could legally transfer his PR over to me through court is that what you meant?

No, he can't just transfer it to you.

The child would need to be living in your care under a Child Arrangements Order or Special Guardianship Order for you to be given PR. It can't just be given to you because he's not around.
