Rules re: supervising a learner driver and foreign licenses

I've posted in chat, but thought maybe somebody here might know...

A bit boring, but I can't seem to find the info online Confused

I am learning to drive and hold a provisional license, in order to supervise me the rules say the person accompanying me must be 21 or over and have held a full license for at least 3 years. DH ticks these boxes but his license is non-EU, non-exchangeable. Is it still okay? I can't find anything to say otherwise and his license is a full one, that he's held for 9 years.

The other issue now is that he's not yet taken his UK test. Rules say he has a year from becoming a UK resident before he can no longer use his license. I don't know if that means from the day we moved here, or the day he was granted legal residence. Our insurance is up for renewal in about 6 weeks, so at that point he will have been driving for a year here (2 weeks after arrival in the UK, 2 months before being legally resident). I'm at a total loss as to when he is no longer allowed to drive, and when he does, will he be able to supervise me? He will still have the other license, he just can't use it to drive here.

It will be a year from when he arrives. And if he doesn't have the entitlement to drive he can't supervise you. The only bit I am not sure on is if he can supervise you on a non eu licence. I would doubt it though.

You can ring DVLA and check. I'm pretty sure you can do so without giving your personal details and they will advise.

This page says he can only supervise you if he's had his license for 3 years and it's from an EU or EEA country.

As for your other question, perfectly is right, it's a year from when he arrives in the country and then he is no longer able to drive.

Ive finally found something useful on the gov.uk site:

The wording doesn't say 12 months from arrival, but from residency. It says:

Holders of non-European Community licences who are now resident in the UK may only drive on that licence for a maximum of 12 months from the date they become resident in this country.

It doesn't say which residency 'test' they apply though which is irritating.

When they become resident is when they start living here.

Which rules have you based that on perfectly? The HRT? He wasn't legally ordinarily resident because his intention was not to stay permanently when we arrived.
SRT is even trickier because it doesn't designate a start point for residency.

Do you think there will be guidance notes for the rules? Like an explanation of them anywhere?

I don't have a link but it is my job to know, and this has always been the rules up until I changed job a few months ago.

Smile thank you perfectlypurple trying to find all the info has been a massive pain. On one very official looking website it says that only British license holders can supervise, which is obviously not the case Hmm

Fortunately I have friends that passed their tests as teenagers that can sit with me. I'm just hoping I pass by our insurance renewal date in October bloody unlikely
