Allergen labelling and buying foods online

I am trying to determine if online food retailers, supermarkets specifically, are required to provide allergen information on their websites for each food item. I'm hoping someone with legal expertise could tell me if the supermarkets NOT providing this information is a breach of the new legislation?

I am looking at the EU FIC 'Distance selling requirements' under section 14, which states "the requirements for those selling to consumers are that the consumer receives the same information when buying food at a distance as they do when buying in a retail environment. Therefore all mandatory food information must be available before the purchase is concluded and at the moment of delivery and must be available to the consumer at no extra cost. "

As the supermarket I use doesn't charge your account until after delivery, does this mean they are not in breach of the part 'available before the purchase is concluded' when their website doesn't provide any of the mandatory allergen information?

Does the manufacturers website contain the information? If it does then the information is available at no extra cost.

No, they don't display any nutritional or ingredient information at all.

Sorry, I meant that the supermarket doesn't display this, and the law states that they are responsible under the distance-selling requirements.

Is the missing information about the 14 specified allergens? They don't have to say anything about any allergens other than those specified in the regulations.

I thought it might be but I'm sure they'd wriggle out of it due to the 'point of Sam's part. They don't take payment until after delivery but in reality, for the consumer, The point of sale appears to be when you finally checkout.

Think I'll call the anaphylaxis campaign and email the company.

There was fairly cler guidance for onlinesales you hd t have it before checkout as that is the point of sale

Most retailers have it on the page for each item
