Grievance at work

Hello all,

I was called to a meeting at work, where I was likely going to be suspended for misconduct.

On route to this meeting, I started to have a panic attack. I called my manager to let him know he passed the phone to the HR person dealing with my case, I informed him I was unable to attend due to being ill.

I work for the nhs and we are able to self certify for the first five working days, the HR person advised he was removing my right to self certify. I asked him to put this in writing he refused and said I had two choices come to the meeting within the next 60 mins or they could come to me.

Can they just remove your rights to self certify at a moments notice?

Can I start a grievance against the HR rep? If so what would be the likely outcome?

Any advice would be truly appreciated

I agree with hoppinggreen, rather than looking possible loopholes in the process, I would concentrate on putting together the best defence to the allegations that you can.

Showing them a bowl of vomit is just grim.

And I've gone ahead with plenty of disciplinaries where the individual has gone off sick in reaction to the potential action being take against them. Sometimes you have to face the music and move forward.

Difficult to comment without knowing more really. But understand this being identifiable.

I kind of understand the "loophole" looking.

For god's sake why on earth did you leave out a bowl full of vomit for them to see? That is childish and riciculous.

Grow and and deal with this properly. Okay so perhaps you couldn't help the first panic attack, but you should have asked for an hour to pull yourself together and then gone in and faced the music. You can't avoid the inevitable by self certifying sick for five days and even if you could, it's hardly going to win you any sympathy or understanding if they sense you are just exploiting the rules to avoid being disciplined.
