Removal from joint tenancy.

Will keep this brief.

Separated around six years ago for various reasons (including not being able to find him for a bit) we are not yet divorced. I am seeing a solicitor to get the ball rolling next week.

When we separated I found our rent account was in massive arrears, we are talking thousands Shock. Since then I have been paying them off religiously and cut by half, they're still pretty hefty though.

I need to get him off the tenancy but housing association won't do until arrears are cleared, even then ex says he won't agree despite not having lived here for all that time.

Can a court order that he be removed from the joint tenancy, even when it's in arrears? Also bearing in mind I have been entirely responsible for paying the arrears this whole time, never missed etc. Even if he doesn't agree?

Many thanks for any advice.

The court has the power to order the transfer of a tenancy on divorce.

A copy of the application is served on the landlord who can object. But if it doesn't affect their ability to recover the arrears from your ex, I can't see it being a problem.
