Residential Lettings Company refusing to give landlord the rent

Hi there
I recently got taken to court as respondent in Financial Remedy court case, husband tried and failed to force sale of family home, got less percentage than I offered him out of court, I was awarded a higher percentage than I asked for and got the family home.

The family home is in the UK, but currently working abroad in the EU and I have new tenants and a new estate agency managing, COUNTRYWIDE RESIDENTIAL LETTINGS. I bitterly regret choosing this agency.

The new tenants moved in 2 months ago.
My husband was joint owner through the first month only, whilst we both followed the court order to sort out finances. The estate agent knew this would happen.
I became sole owner last month.
Countrywide made 13 separate accounting errors on my account, it took me 12 hours on the phone to get them to correct the errors.
Furthermore, Countrywide are refusing to hand over the majority of the rent collected and due to me. The situation has gone on for almost a month.

Countrywide refuse to believe I am the owner of the house. I have provided to them

  1. the court order saying the house is mine on giving husband a lump sum
  2. proof of giving husband lump sum
  3. land registry transfer forms
  4. written instructions from husband confirming he is no longer owner and will therefore not be able to take any rent nor be liable for any bills.

What can I do? I just despair at the situation. After 12 hours on the phone, I really cannot take any more phone calls to them. I get a different person every time. No-one will take responsibility for the situation. Those who've answered have helped in that the accounting errors have been corrected, in that I have managed to convince them to hand over a small amount of the rent they are in possession of. I cannot however get them to hand over the rest of the money.

It is very hard because I am not in the UK. Thanks for any advice.

Contact the tenants direct. Provide them with proof of ownership (unless you're named at the LL on the tenancy) and tell them to make all future payments direct to you. Sounds like the EA may have breached their agreement with you.

The Radio 4 Moneybox programme has a good track record of intervening in cases like this.
