Should I become a legal guardian?

My sister has severe brain damage. My parents are elderly and I have a POA for them which isn't yet invoked. We've mentioned me being a legal guardian for my sister but they were told ages ago that a) someone takes an administration fee each year to 'vet you' b) It's not necessary

I feel concerned that upon their death I would struggle to have any input into her life and the state or her nursing home would cut me out of big decisions about her health and care. If I am guardian they'd be more inclined to involve me. Am I right?

Have a look at this^ from the Office of the Public Guardian.

As your sister sadly doesn't have capacity to appoint you to act on her behalf, you will need to make an application. There are 2 types; health & welfare and property & financial.

There may need to be a hearing, but often isn't.

You will need to pay a fee in theory but may get legal aid for it.

The OPG are enormously helpful so if I were you I'd firstly read through the attached link and then give them a call.
